TERMS AND CONDITIONS OF SALE (CGV)

 

General

 

The Voltaire brand and the www.voltaire.bike website are operated by Voltaire, a société par actions simplifiée with share capital of €54,406, headquartered at 12 Rue Théodule Ribot, 75017 Paris.

The company is registered in the Paris Trade and Companies Register under number 848 755 088, VAT number FR47848755088 (hereinafter referred to as "Voltaire" or "We", "Us" or "Our").

Customer service can be reached by e-mail at [email protected]. Voltaire's website www.voltaire.bike (the "Site") enables users to consult information on the products the company sells on its website and to order or pre-order them, in particular an electrically-assisted bicycle and its accessories. Voltaire also develops mobile applications related to the products it sells. Any individual or legal entity with legal capacity, power of attorney or parental authorization may browse and place an order on the Site (hereinafter referred to as "the Customer", "the User", "You" or "Your").

Use of the Site is subject to acceptance of these Terms and Conditions of Sale and Use and the Privacy Policy (hereinafter referred to as the "Terms and Conditions").

When you use the Site or the Mobile Applications, you acknowledge that you have read, understood and accepted the Terms and Conditions. If you do not agree with these conditions, please do not use the Site and the Mobile Applications. You accept that information concerning the conclusion or execution of the Contract with Voltaire will be sent to you by email and will be kept by the company.

These Terms and Conditions are governed by French law. They may be modified at any time by Voltaire, by simple notification of the Customer by the company and will apply as soon as they are put online.

 

Ordering and pre-ordering

 

An Order or a Pre-order (a "Purchase" or the "Contract") made on the Site is concluded when Voltaire accepts it by return e-mail or when Voltaire executes it, in particular by delivering the order.

The Contract shall not be concluded until Voltaire has received confirmation of Payment of the amount of the Order, in the case of payment by credit card, or until Voltaire has received payment on its account in the case of payment by cheque or bank transfer or any other method.

After acceptance of a Purchase and before its Delivery, Voltaire may terminate the Contract at any time without having to justify itself, in which case Voltaire shall reimburse the Customer's expenses to Voltaire, and only such expenses.

By validating a Pre-Order through the payment of a deposit and the receipt of its confirmation by Voltaire, the Customer acknowledges that, prior to the delivery of his/her Order, he/she must pay the Balance indicated at the time of the Pre-Order.

The Customer may at any time cancel the Pre-Order and request reimbursement from Voltaire by e-mail or from the customer area of the website. Voltaire will then proceed with the reimbursement as soon as possible. In the case of an Order, as long as the goods ordered have not been dispatched, the Customer may request the cancellation of the Order by contacting customer service.

In the case of a Pre-Order, the General Terms and Conditions of Sale applicable to the entire Order will be those applicable on the date of payment of the Order Balance.

In the case of a pre-order, payment of the balance shall constitute acceptance of the General Terms and Conditions in force on the date of payment of the balance.

The Customer acknowledges that the Purchase he has made is personal, and may not be assigned or transferred to a third party without the Company's agreement. The prices indicated on the Site include VAT and are in Euros.

In the event of a manifest error by Voltaire, displaying an unrealistic price for the product at the time of a Purchase, Voltaire will not be obliged to perform the Contract and the Customer will be reimbursed by Voltaire for any amount paid.

 

Deliveries

 

Voltaire will do its utmost to respect the delivery date announced at the time of Purchase, both for orders and pre-orders, but the Customer acknowledges that the announced delivery date may not be respected by Voltaire. In the event of late delivery, the Customer may not claim any compensation.

The customer retains the right to cancel the order until it has been dispatched. In the event of delivery outside Metropolitan France, additional delivery charges may be invoiced.

Voltaire will do its utmost to make these clearly visible when the Order is placed on the Site. The transfer of risks relating to the product and its packaging shall take place upon delivery by Voltaire or the third party carrier to the Customer, and its acceptance by the Customer against signature or any other means confirming delivery.

If delivery is not accepted by the Customer within a reasonable period of time, Voltaire shall be free to dispose of the Order, in particular to sell it to another Customer.

Voltaire's refund to the initial Customer will be reduced by the costs incurred by Voltaire for delivery, return and reminders to the Customer, unless otherwise agreed between the Customer and Voltaire.

 

Withdrawal and return

 

In accordance with the legal provisions in force, as a consumer, you have the right to withdraw from any purchase made on the Website, without payment of a fine and without having to give any reason, within a 14-day withdrawal period.

Voltaire extends this right to purchases in its boutique and on its Internet site to 30 days.

Once complete delivery of the Order has been received, the Customer has the right to withdraw and return the purchase within thirty days of delivery of the Order, without justification and at no additional cost. The Customer must notify his request for retraction via the interface on the Site or by e-mail to [email protected], specifying his invoice number, or via the retraction form in the Appendix to these GTS.

Voltaire will then send the Customer by e-mail a confirmation of the Withdrawal request with the information required to return the Order. The Customer must return the products in their original packaging, within 14 calendar days of receiving the Return information, taking care to package them with the utmost care.

The Customer shall bear the cost of returning the goods to the address in Metropolitan France indicated by Voltaire when confirming that the return request had been taken into account.

In the case of personalized products, such as a frame marked to the customer's specifications, the right of withdrawal will not apply.

 

In the event of damage during the return journey due to inadequate packaging, or occurring between receipt of the Order and its return, the Customer shall be liable for the damage and shall compensate Voltaire accordingly.

In the event that the Customer does not respect its obligations, in particular by not honouring the payment due, Voltaire may suspend its execution or request its cancellation.

Voltaire may claim compensation from the Customer for any costs incurred.

 

Mediation of consumer disputes

 

In accordance with the provisions of the French Consumer Code concerning "the mediation process for consumer disputes", the customer has the right to use the mediation service offered by Voltaire free of charge. 

Customers who have made a purchase on the Site may therefore submit a complaint:

The solution proposed by the mediator is not binding on the parties, who remain free to withdraw from the Mediation process at any time.

In accordance with article L 612-2 of the French Consumer Code, one of the prerequisites for the examination of a dispute by the mediator is that the consumer must have previously attempted to resolve the dispute with the Vendor.
The period within which the Customer may refer the matter to the mediator is 12 months from the date of the written complaint made to the Vendor.

 

Warranty and after-sales service

 

In accordance with regulations, Voltaire products are guaranteed for two years against manufacturing and material defects.

Normal wear and tear of parts, in particular brake pads and tires, are not covered by this warranty.

Once a problem has been identified, the customer must do everything possible to limit any damage and must contact Voltaire's customer service department as soon as possible.

The warranty does not cover problems caused by improper installation not carried out by Voltaire, accident, misuse or lack of maintenance.

Where defects are covered by warranty, Voltaire will replace or repair at its own expense all items in question.
