TERMS AND CONDITIONS OF SALE (T&Cs)
General
The Voltaire brand and the website www.voltaire.bike are managed by Voltaire, a simplified joint-stock company (société par actions simplifiée) with capital of €54,406, whose registered office is located at 12 Rue Théodule Ribot, 75017 Paris.
The company is registered with the Paris Trade and Companies Register under number 848 755 088, intra-community VAT number FR47848755088 (hereinafter "Voltaire" or "We," "Us," or "Our").
Customer service can be contacted by email at salut@voltaire.bike. The Voltaire website www.voltaire.bike (the "Website") allows users to view information about the products that the company sells on its website and to order or pre-order them, in particular a pedal-assisted bicycle and related accessories. Voltaire also develops mobile applications related to the products it sells. Any natural or legal person with legal capacity, power of attorney, or parental authorization may browse and place an order on the Site (hereinafter referred to as "the Customer," "the User," "you," or "your").
Use of the Site is subject to acceptance of these General Terms and Conditions of Sale and Use and the Privacy Policy (hereinafter referred to as the "General Terms and Conditions").
By using the Website or Mobile Applications, you acknowledge that you have read, understood, and accepted the General Terms and Conditions. If you do not agree with these terms, please do not use the Website or Mobile Applications. You agree that information relating to the conclusion or performance of the Contract with Voltaire will be sent to you by email and will be stored by the company.
These Terms and Conditions are governed by French law. They may be modified at any time by Voltaire, by simply notifying the Customer, and will apply as soon as they are posted online.
Orders and pre-orders
An Order or Pre-order (a "Purchase" or "Contract") placed on the Website is concluded when Voltaire accepts it by email or when Voltaire executes it, in particular by delivering the order.
After accepting a Purchase and before its Delivery, Voltaire may terminate the Contract at any time without justification, in which case Voltaire will reimburse Voltaire for the expenses incurred by the Customer, and only those expenses.
By confirming a Pre-order through the payment of a deposit and receipt of confirmation from Voltaire, the Customer acknowledges that, prior to delivery of their Order, they must pay the Balance indicated at the time of the Pre-order.
The Customer may cancel the Pre-Order at any time and request a refund from Voltaire via email or from their customer area on the website. Voltaire will refund the Customer as soon as possible. In the case of an Order, as long as the ordered goods have not been shipped, the Customer may request cancellation of the order by contacting customer service.
In the case of a Pre-order, the General Terms and Conditions of Sale applicable to the entire Order will be those applicable on the date of payment of the balance of the Order.
In the case of a pre-order, payment of the balance constitutes acceptance of the General Terms and Conditions of Sale in force on the date of payment of the balance.
The Customer acknowledges that the Purchase made is personal and cannot be assigned or transferred to third parties without the Company's consent. The prices indicated on the Website are inclusive of VAT and are expressed in Euros.
In the event of an obvious error on the part of Voltaire, which displays an unrealistic price in relation to the product at the time of Purchase, Voltaire shall not be obliged to perform the Contract and the Customer shall be reimbursed by Voltaire for the amount paid.
Voltaire will make every effort to meet the delivery date announced at the time of Purchase, both for orders and pre-orders, but the Customer acknowledges that the announced delivery date may not be met by Voltaire. In the event of a delay in delivery, the Customer may not claim any compensation.
The Customer retains the right to cancel the order until the moment of shipment. In the event of delivery outside mainland France, additional delivery charges may be applied.
Voltaire will make every effort to make this clearly visible at the time of ordering on the Website. The transfer of risks relating to the product and its packaging will take place upon delivery by Voltaire or the third-party carrier to the Customer, and upon acceptance by the Customer by signature or any other means confirming delivery.
If the delivery is not accepted by the Customer within a reasonable period of time, Voltaire will be free to dispose of the Order, in particular to sell it to another Customer.
Voltaire's refund to the original Customer will be reduced by the costs incurred by Voltaire for delivery, return, and reminders to the Customer, unless otherwise agreed between the Customer and Voltaire.
Pickup and return
In accordance with current legislation, as a consumer you have the right to withdraw from any purchase made on the Website, without penalty and without having to justify your reasons, within a withdrawal period of 14 days.
Voltaire extends this right to purchases made in its store and on its website to 30 days.
Once the complete delivery of the Order has been received, the Customer has the right to withdraw and return the purchase within thirty days of delivery of the Order, without having to provide justification and without additional costs. The Customer must communicate their request for withdrawal via the Website interface or by email to salut@voltaire.bike, specifying their invoice number, or by using the withdrawal form attached to these GTC.
Voltaire will then send a confirmation of the withdrawal request by email with the information necessary for returning the Order. The Customer must return the products in their original packaging within 14 calendar days of receiving the return information, taking care to pack them with the utmost care.
The Customer shall bear the cost of returning the goods to the address in mainland France indicated by Voltaire at the time of confirmation of acceptance of the return request.
In the case of personalized products, such as a frame marked according to the Customer's specifications, the right of withdrawal does not apply.
In the event of damage during return due to inadequate packaging or occurring between receipt of the Order and its return, the Customer shall be liable for the damage and shall compensate Voltaire accordingly.
If the Customer fails to fulfill their obligations, in particular by failing to make the required payment, Voltaire may suspend the service or request its cancellation.
Voltaire may request compensation from the Customer for the costs incurred.
Mediation of consumer disputes
In accordance with the provisions of the French Consumer Code relating to the "mediation process for consumer disputes," the Customer has the right to use the mediation service offered by Voltaire free of charge.
Customers who have made a purchase on the Website may therefore submit a complaint:

The solution proposed by the mediator is not binding on the parties, who remain free to withdraw from the mediation process at any time.
Pursuant to Article L 612-2 of the French Consumer Code, one of the preliminary conditions for a dispute to be examined by the mediator is that the consumer has previously attempted to resolve the dispute with the Seller.
The deadline for the Customer to refer the matter to the mediator is 12 months from the date of the written complaint submitted to the Seller.
Warranty and after-sales service
In accordance with the regulations, Voltaire products are guaranteed for two years against manufacturing and material defects.
Normal wear and tear of components, in particular brake pads and tires, is not covered by this warranty.
Once the problem has been identified, the customer must do everything possible to limit the damage and contact Voltaire customer service as soon as possible.
The warranty does not cover problems caused by incorrect installation not performed by Voltaire, accidents, misuse, or lack of maintenance.
If the defects are covered by the warranty, Voltaire will, at its own expense, replace or repair all items in question.
